Personal data is now routinely collected, stored, and processed by both state authorities and private entities, raising important questions about individual autonomy, consent, and accountability. This study examines digital privacy from a combined legal and social perspective, focusing on the evolving constitutional framework, statutory protections, and judicial interpretations in India. It analyses the recognition of the right to privacy as a fundamental right and evaluates the adequacy of existing and proposed data protection laws in addressing contemporary challenges such as surveillance, data misuse, profiling, and cyber vulnerabilities. From a social standpoint, the paper explores issues of public awareness, digital literacy, and the unequal impact of privacy violations on different sections of society. The study argues that effective protection of digital privacy requires not only robust legal safeguards but also ethical governance, transparency, and active public participation. It concludes by emphasizing the need for a balanced approach that harmonizes technological advancement with the protection of individual rights in a democratic society.
2025-10-30T00:00:00+00:00 Copyright (c) 2025 https://www.jmsjournals.in/index.php/jmsg/article/view/333 Factual and Legal Impact of Affidavit Disclosure in Maintenance Proceedings: A Study in Light of Rajnesh v. Neha 2026-02-09T18:54:14+00:00 Dr. Jai Prakash Kushwah jpkushwahadvocate@gmail.com Suraj Pratap Singh Kushwah surajkushwah4903@gmail.com
The concept of maintenance under Indian law embodies the social and constitutional obligation to ensure financial support to dependents who are unable to maintain themselves. With the enactment of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) which replaces the Code of Criminal Procedure, 1973 the provision for maintenance has been retained under Section 144 of the BNSS, continuing the spirit of Section 125 of the former Code. The focal point of adjudicating maintenance claims remains the truthful disclosure of income, assets, and liabilities by both parties. In its landmark judgment Rajnesh v. Neha (2021) 2 SCC 324, the Hon’ble Supreme Court of India introduced a uniform format for filing affidavits of disclosure to curb manipulation, ensure transparency, and secure just maintenance orders.
This research titled “Factual and Legal Impact of Affidavit Disclosure in Maintenance Proceedings: A Study in Light of Rajnesh v. Neha” critically examines the evolution and continuing relevance of the affidavit-disclosure mechanism under the new procedural regime of the BNSS. It analyses how false or incomplete disclosures affect judicial determination of maintenance, and the consequent legal implications such as perjury under Section 227 of the Bharatiya Nyaya Sanhita (BNS), contempt of court, and the setting aside of ex-parte orders obtained through suppression of facts.
The study adopts a doctrinal and analytical approach, reviewing judicial pronouncements from the Supreme Court and various High Courts post-Rajnesh v. Neha, along with evaluating the practical enforcement of affidavit requirements in Family Courts. It further explores whether the BNSS framework strengthens procedural compliance or merely re-enacts prior challenges under a new nomenclature. The research concludes that while the Rajnesh guidelines remain a vital judicial instrument ensuring fairness in maintenance litigation, the effective implementation under the BNSS will depend on statutory codification of affidavit obligations, judicial training, and accountability for false declarations.
2025-10-30T00:00:00+00:00 Copyright (c) 2025 https://www.jmsjournals.in/index.php/jmsg/article/view/334 Can machines understand the Sublime: An Analytical Study 2026-02-09T19:17:15+00:00 Vikas Sharma vikassharmaccsu@gmail.com
The concept of the sublime has traditionally been associated with human experiences of awe, vastness, fear, and transcendence states that arise at the limits of perception, language, and rational comprehension. Rooted in aesthetic philosophy from thinkers such as Longinus, Edmund Burke, and Immanuel Kant, the sublime presupposes a reflective subject capable of emotional depth, self-awareness, and moral imagination. With the rapid advancement of artificial intelligence and machine learning, an important philosophical question emerges: can machines, which operate through algorithms and data processing, meaningfully engage with or “understand” the sublime? This study critically examines the notion of machine understanding in relation to the sublime by distinguishing between functional recognition and experiential comprehension. It argues that while machines can be trained to identify patterns commonly associated with sublime objects such as vast landscapes, complex symphonies, or powerful literary expressions they lack the subjective consciousness and emotional reflexivity necessary for genuine sublime experience. The paper further explores whether simulated responses generated by machines challenge traditional human-centered aesthetics or merely replicate surface-level interpretations. By engaging with perspectives from aesthetics, philosophy of mind, and artificial intelligence ethics, this research concludes that machine interaction with the sublime remains fundamentally representational rather than experiential, thereby reinforcing the uniquely human dimension of the sublime while opening new debates on creativity, perception, and the limits of artificial cognition.
2025-10-30T00:00:00+00:00 Copyright (c) 2025 https://www.jmsjournals.in/index.php/jmsg/article/view/335 Journalism and the Digital Age: An Analytical Study 2026-02-09T19:25:57+00:00 Arpita Sneh arpitasneh@gmail.com
The digital age has brought about unprecedented changes in the nature, structure, and functioning of journalism. Moving beyond traditional print and broadcast media, journalism is now emerging in new forms through the internet, social media, mobile technology, and artificial intelligence. The speed of information production, dissemination, and consumption has become much faster than before. This transformation has, on the one hand, promoted democratic participation, freedom of expression, and citizen journalism, while on the other hand, it has also created serious challenges such as fake news, information credibility, media ethics, and commercial pressures. This research paper analyzes the development, form, impact, opportunities, and challenges of journalism in the digital age and attempts to understand how digital technology is redefining the role of journalism. The study also clarifies that in the digital age, journalism is no longer merely a medium of information but has become an interactive, multidimensional, and people-centric process.
2025-10-30T00:00:00+00:00 Copyright (c) 2025
